Chief Justice Roberts says ‘public opinion’ can’t be the court’s ‘guide’

The Washington Examiner reports that U.S. Supreme Court Chief Justice John Robert recently defended the court against its critics, declaring that “public opinion” cannot be the justices’ “guide.”

Roberts made the comment during the 10th Circuit Bench and Bar Conference that was held in Colorado on Friday.

“If the court doesn’t retain its legitimate function of interpreting the Constitution, I’m not sure who would take up that mantle,” Robert said.

He added, “you don’t want the political branches telling you what the law is, and you don’t want public opinion to be the guide about what the appropriate decision is.”

Those are obvious statements to anyone who understands the role that the Supreme Court plays within our government. But, these days, amid attacks from the political left, they are statements that need to be made.

The Supreme Court has come under attack, particularly following the justices’ recent decision in Dobbs v. Jackson Women’s Health Organization. There, the justices overturned the landmark abortion case Roe v. Wade, returning the abortion issue to the people through their state legislators.

The justices themselves faced all kinds of threats following the unprecedented leak of the draft decision for Dobbs. In response to those threats, a fence was erected around the Supreme Court building. Roberts revealed on Friday that the court will, once again, be open to the public in October.

Robert, though, refused to comment on the leak itself.

Fellow Supreme Court Justice Neil Gorsuch, however, was willing to. He revealed that there is an ongoing internal investigation into the matter, one that he hopes will be completed soon. And, he emphasized that it is “terribly important” to identify the leaker.
